Bac Giang Department of Planning and Investment

The DPI is under the steering, organizational management, staffing of the PPC, and subject to direction, guidance and checking by the Ministry of Planning and Investment (MPI) in terms of profession.

Bac Giang DPI - Functions and duties

Department of Planning and Investment (DPI) is a specialized agency helping the Provincial People’s Committee to perform the function of state management in planning and investment sectors including advising on master planning, programing, socio-economic development planning; organizing the implementation, recommendations, suggestions on the mechanism and policies of socio-economic management; domestic, foreign investment management in the province, ODA fund management, procurement management, business registration within the locality; managing the issues relating to enterprises, collective economies, private sector; provision of public services under its competence in state administration in accordance with the law .

The DPI is under the steering, organizational management, staffing of the provincial people’s committee (PPC), and subject to direction, guidance and checking by the Ministry of Planning and Investment (MPI) in terms of profession.

  1. Functions and and powers

To submit to the PPC:

a) The draft master plan, strategies and five- year and annual socio-economic development plans of the province, allocating local investment budget; provincial investment promotion plan; the main socio-economic balances including the savings and consumption balance, balance of investment development, financial balance;

b) The draft action plan to implement the socio- economic development plan according to the Resolution of the Provincial People’s Council, and is responsible for tracking, summing up the implementation monthly, quarterly, every six month, yearly to report the PPC for coordinating the implementation of the provincial main socio-economic balances;

c) The draft program, plan for restructuring and innovation the state-owned enterprises under the management of the locality; proposed management mechanism and policy to support the restructuring the state-owned enterprises and development of small and medium enterprises of all economic sectors in the province;

d) Draft decisions and directives; programs and measures to organize the implementation of public administration reform (PAR) tasks in the field of planning and investment under its competence of state administration in accordance with the law, decentralized by the Ministry of Planning and Investment;

e) The draft documents on the portfolio of domestic and foreign investment projects in certain period and revised plans in case of necessity;

g) Draft of legal documents specifying the criteria for titles of heads, deputies for Divisions of the Department; Chief, Deputy Chief of Finance - Planning Department in the People’s Committee of districts, city to the agreement with the Department of Finance as assigned by the PPC; Chief inspector of the DPI to the consistence with the Provincial Inspector.

Submit the Chairman of the PPC

a) Draft decisions, directives and other legal documents issued under the authority of the Chairman in the field of state administration of the department;

b) The draft decision on the establishment, merger, separation, reorganization or dissolution of organizations, units of the DPI in accordance with law;

c) Grant, adjust and withdraw investment certificates to the competence of the PPC as decentralized for the DPI.

Assist the Chairman of the PPC in: direction, giving guidance, inspection, information, advocacy and dissemination of legal education in the field of planning and investment; organizing the implementation of legal documents, policies, plans, programs, projects under the competence of its state administration.

On planning and plan

a) Publish and be responsible for the implementation of master planning of socio-economic development after it is approved according to regulations;

b) Manage and administer several fields relating the plan implementation assigned by the PPC;

c) Instruct relevant departments, agencies and People’s Committees of districts, city in developing their plannings and plans in accordance with the provincial plannings, provincial approved socio-economic development plans;

d) oordinate with the Department of Finance to set up provincial budget estimates and budget allocation for agencies, organizations, units in the province.

Domestic and foreign investment

a) Chair, coordinate with the Department of Finance building plans and laying out development investment budget for each program, project using state budget under the provincial management in accordance with the total investment and the investment structure by sectors and fields;

b) Chair and coordinate with the Department of Finance, other relevant departments and sectors to implement checking, monitoring and evaluation of the investment effectiveness in the development programs, projects using state budget in the locality, supervising the community investment in accordance with law;

c) Act as focal point to receive, check, inspect, monitor, appraise, verify the investment projects under the jurisdiction of the PPC;

d) Administer investment activities outside the industrial zones in the province in accordance with law; organize investment promotion activities according the plan approved by the PPC; guide the investment procedures to its competence.

Management of ODA and NGO’s sources

a) Advocate, attract, coordinate the management of ODA and other sources of non-governmental organizations into the province; instruct departments, sectors to build the portfolio and content of programs using ODA and non-governmental aids; summing up portfolio of programs and projects using ODA sources and non-governmental aids to submit the PPC for approval and report to the Ministry of Planning and Investment;

b) Evaluate the implementation of ODA programs, projects and sources of non-governmental aid and handle to its competence or request the PPC Chairman to handle obstacles such as allocating counterpart fund, disbursement under ODA projects and non-governmental sources related to various departments, branches, district and commune levels; regularly report on the progress and attraction effectiveness, investment effectiveness of ODA and non-governmental sources.

Public Procurement Management

a) Appraise and be responsible for the content of the documents submitted to the PPC Chairman on procurement plan, bidding documents, contractor selection results under projects or packages to the competent decision of the PPC Chairman; Appraise and approve of procurement plan, the result of contractor selection under projects or bidding packages authorized by the PPC Chairman;

b) Guide, monitor, supervise, inspect and check the implementation of the provisions of the law on procurement and making reports on the implementation of the approved procurement plan of the approved projects and the status of procurement as required.

Business, business registration

a) Appraise and take responsibility for the projects of establishment, allocation, reorganization of state-owned enterprises under local management; sum up the implementation of allocation, renovation and development of SOEs and the development situation of enterprises in other economic sectors;

b) Organize the implementation and be responsible for the business registration procedures, registration for temporary cease of business, new registration, supplementary content of business, revised business contents, renewal, and revoking the business license, certificates for branch office, representative office in the area under the jurisdiction of the Department; collaborate with relevant sectors to track, sum up and handle violations (to the competence) made by the businesses after their business registration; collect, record, store and manage information about business registration in accordance with the law.

Collective economies and private sector

a) Be the hub of summarizing, proposing models and mechanisms, policies, plans for collective economic development, private economies; guide, monitor and evaluate the implementation of the programs, plans, mechanisms and policies for collective economic development, private sector, and the operation of collective economic entities and the private sector in the province;

b) Chair, coordinate with other relevant agencies in resolving obstacles to the policies of collective economic and private economic development with inter-disciplinary nature;

c) Act as focal point in coordinating with other domestic and international organizations and individuals in research, collecting experience and building programs, intervention projects to attract capital and resources for the development of collective and private economies into the province;

d) Regularly prepare reports under the guidance of the Ministry of Planning and Investment to submit to the PPC, MPI and relevant Ministries, ministerial-level agencies about the situation of collective economic and private sector development in the province.

10. Implement the international cooperation in the field of planning and investment in accordance with the law and assigned or authorized by the Provincial People’s Committee.

Be responsible for professional guidelines in the field of planning and investment under the management of the planning and investment sector for Finance - Planning in the People’s Committees of districts, cities.

Conduct research and application of scientific advances, develop system of information and recording to facilitate public and professional management in the assigned field

Inspect, check, handle complaints and denunciations in accordance with the law; handle to its competence or propose competent authorities to handle violations against the law in the fields under its management competence itself; prevent and fight against corruption, negative actions, keep thrift practices and against wastefulness.

Define the functions, duties, competences and work relationship for the units of the Department, manage staff and implement wage policies of preferential treatment, training, fostering, rewarding and discipline policies for cadres and civil servants under the administrative jurisdiction of the Department itself in accordance with the law and the PPC’s decentralization.

Manage the allocated finance source, assets in accordance with law and assigned by the PPC.

Perform the task of sharing information, regularly and unexpectedly report about the situation of performing tasks prescribed by the PPC and MPI.

Perform other tasks assigned by the PPC in accordance with law.

  1. Organizational structure and staffing

Department leaders: consists of the director and not more than 03 (three) Deputy Directors;

a) The Director is the head of Department, responsible to the PPC, Chairman of PPC and before law for all activities of the Department; responsible for performance reporting before the Provincial People’s Council, Provincial People’s Committee and the Ministry of Planning and Investment as stipulated;

b) Deputy Directors of the Department are to help, responsible to the Director and before the law on the duties assigned; as the Director is absent, one Deputy Director is mandated by the Director to chair all the operation of the department;

c) The appointment, re-appointment of director and deputy directors shall be made at the PPC’s decision based on the professional qualifications by the competent authority and in accordance with the Governmental provisions in managing officials and civil servants.

The staffing, rotation, reward, discipline and dismissal, the resignation, retirement and implementing other policies for the Director, Deputy Directors of the DPI shall comply with the provisions of the law.
